PUBLIC CONTRACT (OFFER) for ordering, purchase, sale and delivery of goods
1. General Provisions
This Agreement is an official and public proposal (offer) of Romina Marinivna Unguryan, Individual Entrepreneur Code 3241620763 to conclude a contract of sale of the Goods presented on the website www.mongol-arm-sport.com This Agreement is public, that is, in accordance with Article 633 of the Civil Code of Ukraine, its terms are the same for all buyers regardless of their status (individual, legal entity, individual entrepreneur) without giving preference to one buyer over another. By concluding this Agreement, the buyer fully accepts the terms and procedure for placing an order, paying for the goods, delivering the goods, returning the goods, liability for an unscrupulous order and all other terms of the Agreement. The Agreement is considered concluded from the moment of clicking the "Confirm Order" button on the order page in the "Cart" Section and the Buyer receiving an order confirmation from the Seller in electronic form.
2. Terms and definitions
2.1. Public offer - this offer of the Seller, addressed to an unspecified circle of persons.
2.2. Acceptance - full and unconditional acceptance of the offer.
3. Subject of the contract
3.1. The Seller undertakes to transfer, and the Buyer - to accept and pay for the goods ordered on the website mongol-arm-sport.com
4. Ordering and payment for the goods
4.1. The Buyer independently selects and places an order on the website.
4.2. Payment for the goods is made by the Buyer in the manner chosen when placing the order.
5. Delivery and transfer of the goods
5.1. Delivery of the goods is carried out in the manner specified by the Buyer when placing the order.
5.2. The risk of accidental loss or damage to the goods passes to the Buyer from the moment the goods are transferred to him.
6. Rights and obligations of the parties
6.1. The Seller undertakes to transfer the goods in accordance with the Buyer's order.
6.2. The Buyer undertakes to pay for and accept the goods under the terms of this Agreement.
7. Liability of the Parties
7.1. The Parties are liable for failure to fulfill or improper fulfillment of the terms of this Agreement in accordance with the current legislation of Ukraine.
8. Other Terms
8.1. All disputes arising from this Agreement shall be resolved through negotiations or in court in accordance with the legislation of Ukraine.
9. Force Majeure
9.1. The Parties are exempt from liability for failure to fulfill obligations under the Agreement if the failure is a consequence of force majeure.
10. Recognition of the Agreement
10.1. By confirming the order of the goods on the website mongol-arm-sport.com, the Buyer agrees to all the terms of this Agreement (public offer).
